TERMS AND CONDITIONS
It is understood that Lisa Felthous/Lisa Felthous Photography is the exclusive official photographer retained to perform the photographic services requested on this contract.
Upon signature and full session fee payment, the Photographer shall reserve the time and date agreed upon. All sitting fees and retainers are nonrefundable
24 hours notice is required should the Client need to reschedule. If the Client requests a second reschedule he or she has chosen to forfeit the entire session fee. To reserve another time slot, a new session fee will be due.
All “no shows” or those who give less than 24 hours notice forfeit their entire session fee. A “no-‐show” is defined as someone who has not arrived within 15 minutes of their scheduled session time. The Photographer will assume a “no show” situation after 15 minutes and will not remain “on location” beyond this point.
The Photographer withholds the right to reschedule sessions due to illness, inclement weather, acts of God, etc. Should the Photographer find it necessary to cancel a session the full session fee will be refunded to the client and shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, Lisa Felthous Photography shall not be liable for any amount in excess of all monies paid.
The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographeed; taking time to pose for photographs at the Photographer’s direction; pre-shoot consultaions; post-shoot viewing session; etc. The Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation.
On the day of the session, the Client will come prepared to schedule a viewing/ordering session that will take place within 2 weeks of the photo shoot. Complete orders will be placed at the viewing session and payment is due in full at this time. All sales are final and no changes will be permitted once payment is received, including last minute additions. The Client accepts responsibility for becoming knowledgeable of all print and product pricing before retaining the services of Lisa Felthous Photography.
Most orders will take 4 weeks to arrive. Larger orders, including but not limited to custom albums and books will take 6 weeks. The customer will be notified when the order is ready and is responsible for picking up the order from Lisa Felthous Photography studios.
Lisa Felthous Photography does not guarantee that digital images of any session will be available after the order is processed.
All images are created by and property of Lisa Felthous Photography. Lisa Felthous Photography retains all copyrights per USC Title 17 (US Copyright Law). The images that are being provided to you are licensed to you for any reasonable personal purpose, including, but not limited to: printing, emailing, and web publishing. Alteration of these images in any manner or use for financial gain is in direct violation of USC Title 17.
Lisa Felthous Photography reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of Lisa Felthous/Lisa Felthous Photography.
This Contract incorporates the entire understanding of the parties and is governed by the laws of Collin County, Texas. Any modifications of this contract must be in writing and signed by both parties.
